Posted by: Mr. Vachaspathi V At: 19, Jan 2006 2:28:21 PM IST 1.Contempt means the comments againt Judgments and also againt Judges.
2.I will watch the Movie and let you know if there is anything that attracts "Contempt of Courts"
3.The Politician was served a notice and the inquiry is pending before the Court.

Does contempt of the court mean "Comments against the Judgement" or "Comments against the judge?"
Posted by: Malakpet Rowdy At: 13, Jan 2006 5:13:46 PM IST Then immediately the Supreme Court has issued a Contempt Notice to that Politician.

Was that politician punished or jsut served a notice?
Posted by: Malakpet Rowdy At: 13, Jan 2006 5:11:25 PM IST I watched that Movie on Zee Cinema a few days back. Danny is the Villian n Sunny Deol & Sanjay Dutt are Heros. The name of the Movie is "YODHA"
Posted by: Malakpet Rowdy At: 13, Jan 2006 5:09:17 PM IST Sometime back Press reported immoral acts of few High ranking judges in Karnataka. It was hushed-up, no such contempt of court.
Misappropriation of funds by a senior judge of SC came in papers, nothing happened to the reporters.
To my understanding, due respect should be given to the position, but not to the person. If it is so, there is no meaning to the very right of 'equality before law'.

The Legislature, the Executive and the Judiciary are the three Organs of the government. All these three organs are independent of each other to some extent.
But the Lok Sabha can frame the charges of misconduct of a High Court Judge and the Rajya Sabha will debate on it and vice versa. The Parliament can also recommend for impeachment of the Judge if the charges are proved. While so, the press can give the information regarding the debates of the Parliament and will not make a direct comment on the Judges. This was how the press has reported earlier.

There has also been a bollywood movie made, in which the Villain happened to be a Judge/Magistrate!

Some time back some politicans from Hyderabad have commented on the Supreme Court by saying, "If they wish they may close the Courts".Then immediately the Supreme Court has issued a Contempt Notice to that Politician.
No person who has been convicted can be appointed as a Judge of a Court.
Please give me the name of the movie so that I will try to know the gist of it and let you know if it amounts to Contempt of Court or not.
Posted by: Mr. B.A. Tilak , Advocate. At: 13, Jan 2006 3:35:26 PM IST //Judges will be punished with imprisonment (jail).//
Why they should be punished? Contempt of court!! :))

As per the principles of Interpretation of Statutes, a text has to be studied from the first word to the last word of the text.Only then you can understand the full text.Reading only some excerpts or breaking a sentence and reading it is very bad.
Posted by: Mr. B.A. Tilak , Advocate. At: 13, Jan 2006 3:32:30 PM IST Is n't it sounding more like a privilege? Does it mean, Judges have more protection (from comments on them) than other normal civilians / professionals?
What about some one commenting nonsense about other professionals viz. Doctors, Engineers etc.

=======
When we have a dispute, we go to the court and the court will deliver the judgement. But we will not go to any other professionals like Doctors, Egineers, Chartered Accountants etc.
When the Courts deliver the Judgements we have to follow them be it ordinary civilians or the Governemnt or the Police.
Police is a very powerful Department. For example if the Court directs the Police to do something, the Police have to do it.If the Police thinks that it is very powerful so it need not obey the directions of the Court -- then what will be the fate of the system of governance?
Therefore the powers of Contempt is given to the Courts (and not to the professionals like doctors, engineers etc.)Then the Courts will issue the notice of Contempt to the disobeying Police so as to enforce its direction.Hence CONTEMPT include respecting the Courts and Judges and also free from being commented. There will also be budgetary control like stoppage of salaries, dismissal etc. through the Executive. These are the powers given to the Courts and Judges. They are also having the inherent powers.
How can it be possible that the directions of the Courts and Judges are implemented by the Police on the one hand and are commented on the other hand.
If there is any defamation to the other professionals like doctors, engineers etc. - they may file a defamation suit.
