Hyderabad, 3nd May 2005. To, The Honorable High Court of Andhra Pradesh, Hyderabad. Sub: PIL-Request-Private Telugu T.V. Channels. Sir, I, Mr.Velavartipati Vachaspati, did my M.A (Political Science), M.A (Anthropology) and qualified NET (Anthropology), worked as Sub – Editor in Andhra Prabha, a Telugu Daily, presently writing articles to the same. The purpose of this letter to the Honorable High Court is to call for attention about the attitude and themes of Private Telugu T.V.Channels. It’s very bad to see that some channels like TV and Gemini TV have airing objectionable content that made women a villain. Among many serials women as a villian fighting within-laws, poisoning her in-laws, indulging in family politics for property with villainy expressions. Not even single theme is found promoting legal literacy among masses in these serials. No women fights for justice knocking the doors of courts. No theme revolves around the real empowerment of women. Though we have Abolition of Dowry Act, 1961, not even single woman is found fighting against Dowry. No serial shows the rural Indian Women’s problems and no theme revolves around them. Andhra Pradesh has achieved something wonder in the implementation of DWCRA, a scheme for Empowerment of women. But no serial’s theme revolves around the scheme. Not even innovative experiment is shown in this regard. More over, these serials don’t attract the interest among the youth of the society, who are going to be future citizens of the country. For them these serials are distasteful. The airing of these serials with perverted themes that are meant for only promoting the revenue and business of the channels and their management, but made women, particularly housewives and retired employees to sit before the T.V continuously for hours. Continuous sitting before the TV’s will definitely hamper the health. Many aged people have almost forgotten the need for morning walk and evening walk. More over, sitting before the T.V continuously and watching serials that show only family politics and meaningless dialogues missing minimum enlightenment not only spoils the health but mind too because of involvement in the characters of those serials. Men go to work and children go to school or college, but women sit before the T.V. If they are sleepy, sleep before the T.V., they are hungry eat before the T.V. Even after men and children return from outside, they seldom get any change to watch the channel like BBC, National Geographic or History channel. Due to this divergent thinking patterns results among the family members and cause the generation gap. If the youth of the society misses the news, National Geographic or History Channel, there is a danger of missing rationality and enlightenment. They struggle to get succeed in their career, for it enlightenment, rationality and broad views are necessary. But private T.V channels hijacked the elders of the family with their serials. In this era of Information Technology and related revolution in the country, society needs enlightened future citizens to understand and reduce the evils of the society. But senior citizens in general and women in particular stick-up with these Private T.V. Channels that shows only meaningless negative women roles and deny the viewing right of the young children at home. Children just can’t fight with their parents to change the channel from Serial of Family Politics to National Geographic or BBC or History Channel. If any children protested seriously against parental absolutism results with the dialogue-“ This is my T.V and I pay the Cable Bill. You go and study.”- will be the reply from their mother in many families. Children will generally hurt with these kind of harsh wards from their mother and leave the place allowing their mother to spoil her health and mind. This description is not at all exaggerated. There was news in several dailies that children commit suicide after her/his mother or father or both scolded them for changing the channel or agitated for not changing the channel. Hence, parental irrational absolutism at home regarding the viewer ship of the serials that show only family politics, deny the youth’s right to watch the BBC, National Geographic or History Channel or even Doordarshan. The real culprits are not parents, but the T.V. serials and victims are nothing but future citizens of India. These private T.V. Channels survive with the constant viewer ship that is nothing but women only. To escape from these channels men leave home for work before 9.30 a.m. and return after 11.00p.m. Children will be studying amidst of noisy atmosphere from these T.V. Serials and women are immersed and meditating inline with the roles in those serials. This is the condition among many families in the society. People almost forgotten the Doordarshan, the official channel that shown some of the best serials like Buniyad, Hum log, Bharat Ek Khoj, Life Line etc., All these were shown just half an hour to one hour a day that too only nights. Remaining time of Doordarshan was allocated the time to different sections of the society. Whoever wants to see a particular program simply comes time, see and go. But these Private T.V. Channels start telecasting serials of family politics from 8.30 a.m. to 11.00p.m, promoting no rationality and enlightenment. Many serials ran more than several hundred episodes till now. That means for years, youth of the state has been denied their right to see the channel of their choice has been denied. Even kids aren’t allowed to see Cartoon Network in many families. It’s shame of the system VIPs of the system that is nothing but children denied of their right to develop innovativeness due to the parental absolutism. More over the Private T.V. Channels are causing internal troubles and frequent quarrels right in home on the question that wants what channel. Elder’s sit before the Serials and kids are crying for Cartoon Network became a common scene in several homes. These serials with retrograde themes preventing women to break the barriers of their real empowerment and trying to consolidate their subordinate position in the system by brainwashing with themes of family politics. Article 19(I)(g) of the Constitution of India guarantees that all citizens shall have the right ‘to practice any profession, or to carry on any occupation, trade of business’. However, the right to carry on a profession, trade or business is not unqualified. The authority of law can restrict it. Thus the State can under Clause (6) of Article 19 may make any law- (a) imposing reasonable on this right ‘in the interest of the public’, (b) prescribing professional or technical qualifications necessary for practicing any profession or carrying on any trade or business, (c) enabling the State to carry on any trade or business to the exclusion of citizens wholly or partially. Under this Article 19 of the Indian Constitution, the Private T.V channels that telecast the meaningless serials that only meant for time pass of one part of the population and hampers the majority section of the society must be restricted, regulated or controlled by the law in the interest of the public. The Honorable High Court of Andhra Pradesh is requested to get the CDs or VCDs of the serials of these Telugu Private T.V.Channels and examine the facts written in this letter. The Honorable High Court also requested to look after this matter regarding the Private T.V.Channels and serials issue seriously and direct the Government to enact a law restricting the time space of those serials to only two hours a day at evenings. And Honorable High Court also requested to direct the Government to constitute an autonomous body headed by retired High Court Judge and other eminent social workers and journalists to clear the script of those Serials before being shot. This is necessary to make Private T.V.Channels and serials to be made accountable and responsible to the objectives enshrined in the Constitution of India. Private T.V.Channels are run by business barons and for them serials means business. Hence must be regulated. With regards, Yours Sincerely, (V.VACHASPATI)
