Dowry Abolition Act, 1961
Posted by: Bahud♥♥rapu Baatasaari At: 30, Jun 2005 8:24:54 PM IST It’s tragedy to observe that no government in India, both the state governments and the Center, has responded even after the Supreme Court’s caution on 2nd May 2005 with serious and harsh words about the implementation of the Dowry Prohibition Act, 1961. It even warned to issue the writ ‘mandamus’ regarding the implementation of the Act. The patriarchal mindset of the system may be the reason in to act ineffectively from 1st July 1961 to till date. The situation is really hopeless from the part of the governments. Section 2 of the Act defines that ‘Dowry means any property or valuable security given or agreed to be given either directly or indirectly, (a) By one party to a marriage to the other party to the marriage, or (b) By the parent of either party to a marriage or by an other person.’ This definition of dowry, as Act says, is wide to include all sorts of properties, valuables securities etc. given or agreed to be given directly or indirectly. While Dowry signifies presents given in connection with marriage to bride, the socially institutionalized practice i.e., Sridhan is confined to the property given to or meant for the bride. Section 6 of the Act says, ‘where any dowry is received by any person other than the women in connection with whose marriage it is given, that person shall transfer it to the women – (a) If the dowry was received before the marriage after the date of the marriage, or (b) If the dowry was received at the time of or after marriage within after the date of receipt. If any person fails to transfer it as specified by the Act, shall be punishable with imprisonment for a term which shall not be less than six months, but may be extended to two years or with fine which shall not be less than five thousand rupees, but which may be extended to ten thousand rupees. If the beneficiary who is nothing but bride dies before receiving it, the heirs of that woman shall be entitled to claim it. If she has not children, that money shall be transferred to her parents. Here the Act contradicts with patriarchic practice. Woman has overwhelming rights over Sridhan but not dowry. If the Supreme Court redefines the Dowry by widening the scope by declaring Dowry too as Sridhan, many problems will be solved. Money or wealth of a woman will be with that woman and her heirs only. The Supreme Court need to look at this angle too.
