Courts and their Jurisdiction: Are they stepping over the toes of legislature?

Excellent Topic and Great Comments... I support MR, HM Rachuri and Sastryji. Is there anyway that our comments be heard by the politicians, courts and the public? I guess most of the people in India especially from these areas are not yet using internet. Can the site admin or somebody here take this message from TP to those who need to hear these comments?

One naked truth we all should remember that the qualification for entry into Assembly or Lok Sabha is vote getting capacity and not by any educational qualifications. Even an illeterate can stand elected and can be given the educational portfolio. But this is not the case with the Judiciary. An experienced law qualified person only will be appointed as Judge. You find the difference of exercising the authority both in Assembly, Loksabha and Courts. Have we ever found any intruders to the bench in a court? But it is so happening every day in the Assebly and Lok sabha. Honourable Judge can either allow or rule out an objection and his ruling is final. The proceedings in a court will never appear mockery like that of legislative assemblies or loksabha. The laws made by the elected members at their whims and fancies should be checked in par with the Constitution and Law before they are implemented. I personally feel that any minister who is given a certain portfolio should have sufficient qualification and experience in that portfolio so that he may not take wrong decessions. (example is Late Dr. K.L.Rao and present Prime Minister Dr.Manmohan Sing, Late Desmukh and so on). Like Governors and President, the Ministers also should come out of Parties aslong as they rule the country. However, these members or ministers should have moral binding and god fearing. I personally feel that Judiciary should have upper hand over both the Legislation and Administration.

It is highly deplorable the way elected representatives bahaviour in legislature. They are making a mockery of our constitution. Instead of finding better ways to deal or curb bad practices they are encouraging with least respect to constitution provisions. Legislature is empowered to make laws. But they are also to be bound by the laws. They can not super power. When supreme authority President can be impeached, similarly the elected representative can be called back if he is guilty. Provision for calling back MLA/MP will keep them in check.

When the legislature fails to meet its expectations, Judiciary becomes active - this is the only way to keep the jokers oops .. I mean the 'respected' elected representatives of the people .. under check. Does Somnath Chaterjee mean to say that the Assemblies and the Parliament are the 'Jagir's of Speakers/Members?

Speakers to courts: Do not overstep limits. In fact, this might be the core message. It is imperative to maintain harmonious relations between the legislature and the judiciary - is the concern expressed by the presiding officers of legislative bodies in a conference held on March 20 in NewDelhi. The meeting was convened by Loksabha speaker Somnath Chatterjee in the backdrop of the Supreme Court’s interim order on the Jharkhand case. Is legislature a subordinate to judiciary or viceversa?
