Posted by: Bahud♥♥rapu Baatasaari At: 27, Jun 2005 10:25:32 AM IST The main issue for any parent is not giving or taking dowry. When something like dowry is given and accepted , generally it has the consent of both the parties, whatever be the circumstances. The issue of importance is that how the boy takes care of the girl and whether there is pressure to get further dowry etc., Likewise, whether the girl fully enjoys her stay with the new husband/in laws? I know circumstances, where the girl has left the boy, what is the position of the boy then? The basic point is everybody wants the new relationship to be hormonous and a happy association. The issue of dowry is really irrelevant or secondary then

tilak gArU...
Even though the dowry has received without any demand, it must be return to the bride within three months. If failed, five or ten years imprisonment and Rs.15000 penalty will be the punishment. Is that right? If the dowry is above Rs.15000 rupees, the punishment will be even higher. Is that not right?

Thanks for your timely intervention. Legal literacy is seriously missing here just like anywhere else. People are not even interested to know the facts. It seems all the people here who are married has taken dowry. That's why they are raising petty questions to divert the discussion.
Posted by: Mr. Vachaspathi V At: 25, Jun 2005 9:27:09 AM IST And By the way .. why is no one talking about the Gifts (Like Golden Jewellery) given by the family of the groom to the Bride? Doesnt it come under dowry?
Tilak garu, can U throw some light on this?
Posted by: Malakpet Rowdy At: 22, Jun 2005 1:26:05 PM IST
---------------------------------------------
Mr. MR,
The gifts like golden jewellery, etc. given by the family of the groom to the bride is also called as dowry. This can be seen from section from 4 of The Dowry Prohibition Act, 1961.
SECTION 4 of The Dowry Prohibiton Act, 1961.
Penalty for demanding dowry-- If any person demands, directly or indirectly, from the parents or other relatives or guardian of a bride or BRIDEGROOM, as the case may be, any dowry, he shall be punishable with imprisonment for a term which shall not be less than six months , but which may extend to two years and with fine which may extend to ten thousand rupees.
Provided that the Court may, for adequate and special reason to be mentioned in the judgment, impose a sentence of imprisonment for a term of less than six months.
NOTE: Giving or taking dowry is not punishable if the same is followed according to the The Dowry Prohibition Act, 1961 and the Rules thereof. Only DEMANDING dowry is punishable.
