Posted by: ★Vinåyåkåm★ chitt♥♥r At: 8, Oct 2005 7:16:36 PM IST The UPA government’s decision to dissolve the Bihar Assembly drew flak from the Supreme Court, which on Friday called the dissolution of the Bihar Assembly as ‘unconstitutional.’
However, the bench cleared the decks for four-phased elections in the state starting October 18.
“Despite unconstitutionality of the impugned proclamation, but having regard to the facts and circumstances of the case, this present case is not one where in exercise of discretionary jurisdiction, the status quo ante deserved to be ordered to restore the legislative assembly as it stood on the date of proclamation dated March 7, 2005 where under it was kept under suspended animation,” the bench said.
Although the apex court did not censure anyone by name, its order on Friday holding the dissolution of the Bihar Assembly unconstitutional has put four people in the firing line: the President, who gave his assent to the recommendation; the Prime Minister, who presided over a late-night Cabinet meeting to approve the decision; Home Minister Shivraj Patil, who heads the nodal ministry involved in the decision, and Governor Buta Singh whose report made the case for Central Rule.
Highly placed sources said that the most plausible face-saver the Government was working on was to ease Buta Singh out - most likely, move him to another state in a swap.
‘PM must introspect how he landed in this conspiracy. There are three partners in this conspiracy: Centre, Governor and RJD and its leader Laloo Prasad Yadav’ said BJP.
The ruling partner Congress party is looking for face saving measures. ‘This is definitely a setback to Govt position. After going through complete judgment, Govt will take corrective measures,’ said a party spokesperson. Give your comment.
