The Reserve Bank of India will submit a report on the controversial Margadarsi Financiers to the union finance ministry soon, sources said.
The RBI summoned company representatives to its head quarters a couple of days ago and sought their explanation on various issues before preparing its report.
//Sources said that RBI officials were of the firm opinion that the company had no right to collect deposits under any category mentioned in the RBI Act 1934. //
“We have asked the company to explain under which category they can collect deposits,” an RBI official said. “How to classify the company under the Act is a big question.”
//RBI officials feel that the company had been exploiting a grey area in the Act and are planning to recommend necessary changes to avoid such problems. //
Significantly, the RBI released its policy statement on regulation of non-banking financial institutions (NBFCs) just three days before Congress MP Vundavilli Aruna Kumar complained to Union finance minister P. Chidambaram about Margadarsi Financiers.
In its policy statement, RBI was categorical that all such institutions ought to be brought under a suitable regulatory framework to contain systemic risk.
//A senior RBI official is believed to have referred to the policy statement while suggesting that Margadarsi be brought under the regulatory framework. “Had Margadarsi’s affairs been regulated, the indiscriminate collecting of deposits despite the loss of Rs 1,100 crores would have not taken place,” the official said. //
Referring to the claims of investments made by Margadarsi Financiers, the official said the policy statement favoured prudential norms or guidelines on such transactions so that they would not be a threat to financial stability. However, there were differences of opinion among RBI senior officials on asking Margadarsi Financiers not to accept fresh deposits. Many felt that this would create panic among thousands of depositors.
“We will be doing what we are expected to do but at the same time we don’t want to go public,” a senior RBI official told this correspondent. “Margadarsi is clearly not acting under law. Their argument that 45(s) does not mention Hindu Undivided Family will not hold good. Margadarsi is an unincorporated body which cannot collect deposits,” pointed out D.A. Somayajulu, financial expert and advisor to State government on economic affairs.
Explaining the objective of Parliament in bringing amendment in 1997 to incorporate 45 (S), Mr Somayajulu said the former wanted that the companies involved in collecting deposits from public should be transparent, work under a regulatory agency and throw open all its accounts to public scrutiny.
