Some unlikely hurdles on way to Telangana Hyderabad: Though the creation of the 29th State is only a Presidential signature away, there are a couple of issues which might come in the way of Telangana.
It is hypothetical and appears most unlikely at the moment, but the issues are capable of becoming hurdles. President Pranab Mukherjee has a constitutional right to send the Bill back to Parliament on the grounds that the Bill is defective and no debate took place in Lok Sabha.
Though the session of Parliament ends on Friday, both the Houses could be summoned again if the President so wishes to reconsider the Bill. It would be an extraordinary decision by the President, but it is not out of the purview of the constitution.
RS is a permanent House. The 15th Lok Sabha would be there till the next LS is formed on June 1 after polls. If there is a wide gap between the notified day and the appointed day (actual formation of the new State), there would be a possibility for the intervention by Supreme Court where petitions would be filed in large numbers.
The gap at the time of formation of Andhra State was just eight days. At the time of AP formation, the notified day and the appointed day were 40 days apart. If the gap is more, the chances of SC stalling the process on the grounds of constitutional provisions not being adhered to would be more.
