Centre likely to dissolve Assembly Hyderabad: The Andhra Pradesh Assembly might be dissolved in a few days to facilitate the Centre to re-impose the President Rule in May. Solicitor General of India Mohan Prasaran is understood to have made a recommendation to the Centre to this effect.
The Solicitor General, who met Prime Minister Manmohan Singh, reportedly stated that the Assembly would have to be dissolved to facilitate re-imposition of President Rule in May.
He conveyed to the Prime Minister that it would not be possible to take that decision if the Assembly was in continuation.It would not be possible for the Centre to continue President Rule in a State if it was not ratified by either houses of the Parliament within two months from the date of imposition as per the Constitutional provisions.
In this scenario, Parasaran suggested that the Centre had to let the President Rule lapse automatically and to re-impose it immediately citing the situation in the State where it is not possible to install an elected government.
This Constitutional question has arisen as the President Rule is set to expire on April 30 and it would not be possible to get it ratified by either houses of the Parliament before that.
There are no established precedents in the history which suggest a way out in such circumstances than the one recommended by Parasaran. The Centre is of the view that it would not be possible to summon the Parliament for a session as the election process is already underway and such an action would be counted as violation of model code of conduct.
The President Rule in the State was imposed on March 1 and two months' time would expire on April 30 midnight. In such circumstances, the Centre has to revoke the Assembly which was put in suspended animation and to try to install the government.
This option is not possible in the State since no party could form the government. However, if the President Rule has to be imposed again, it has to be dissolved first. The imposition of President's rule, while keeping the Assembly in suspended animation, would lead to legal complications, sources said.
