HC moved against Telangana Bill HYDERABAD: A petition was filed in the High Court with a request to restrain the Union of India from introducing the AP Reorganisation Bill-2013 in Parliament by invoking Article 3 of the Constitution without amending Article 371(D) and without examining the views expressed and resolution made by majority opinion of the state legislature.
Petitioner PV Krishnaiah, a practising advocate of the High Court, submitted that the Centre had no authority to invoke Article 3 of the Constitution to bifurcate the state of Andhra Pradesh and form a new state of Telangana as long as Article 371(D) existed.
He prayed the court to declare that Article 3 was violating the basic structure and Preamble of the Constitution apart from being inconsistent with other provisions of the Constitution. He sought a direction to the Centre to amend the same suitably keeping in view the basic structure of the Constitution.
The Union cabinet secretary, secretary in the ministry of home affairs, secretary-general to RS and LS secretariats and state chief secretary were named as respondents.
