SC refers disqualification plea to new bench Hyderabad, Nov 8 (INN): The Supreme Court on Tuesday referred the petition filed by Congress MLA A. Sampath Kumar and others pleading disqualification of defected MLAs to larger Constitutional bench.
It may be recalled that the Congress leaders had filed a petition pleading the Supreme Court to direct the Speaker to dispose off their disqualification pleas against the MLAs who crossed Assembly floor to join the ruling TRS.
After listening to the arguments of the two sides, the two member bench was of the view that they had no hope that the Speaker would act on their pleas and the matter would handed over to a larger Constitutional bench to ascertain if the Court had power to direct the Speaker in this regard. The matter has now been referred to a five member Constitutional bench.
