Politics behind Prorogue drama Hyderabad: It is evident that the gazette approved by the governor stating that the assembly session has been concluded is known as Prorogue. As soon the assembly session concludes, the governor of the state receives a note from the speaker of the state assembly to that effect. Then the governor approves the gazette, which is widely known as prorogue. The last assembly session of the state was concluded on June 21.
By now, almost 5 months are over. The speaker of Andhra Pradesh assembly received a proposal from the government that Assembly should be prorogued, 3 weeks back.
The speaker has not yet signed the proposal. In fact, the fault lies with the government and not on the speaker, as they have sent the proposal after many days of conclusion of assembly. But, it is evident that there has been a plan of blaming the speaker for not sending the proposal for approval of the governor.
If published in gazette, there is a need of seeking permission once again for conducting the assembly session from the governor. Depending on the case, the governor will act accordingly.
Prior information should be received by the governor at least 7 days before scheduled assembly session. If published in the gazette, the governor needs to send information regarding the assembly session to all MLAs before, 7 days.
If not published in the gazette, only 3 days are sufficient for issuing a notice to the MLAs. If there is a need of taking up an urgent matter, even before the prorogue, there is a need for holding an assembly session.
It means the house has not been adjourned, so far. The Chief Minister supporters say that for making an ordinance, it is required to be prorogued. Hence, they said, they wanted an ordinance to that effect.
If the bifurcation bill reaches the state assembly, the governor needs to pass an order for holding an assembly session. It has been CM's tactic that based on this clue; he wants there should not be any assembly session without his concurrence.
One of the basic requirements to conduct an assembly meet is to have the permission of the ruling government. But, in special cases when ordered by the president the governor can in turn order for an assembly meeting.
According to sources, the matter of prorogue has now been in the court of the state governor, ESL Narasimhan.
