Delhi HC adjourns Kavitha's bail plea Hyderabad, May 27 (INN): The Delhi High Court has adjourned the bail plea of MLC Kavitha until Tuesday.
Justice Swarnakanta Sharma will hear the bail petitions filed in the CBI and ED cases on Tuesday. The petitions challenge not only Kavitha's bail but also her arrest and the demands made by the investigating agencies. Advocate Vikram Chaudhary represented Kavitha, arguing that central investigation agencies violated the law during her arrest. Both the ED and CBI have already submitted counter affidavits.
During the hearing, Kavitha's lawyer highlighted several critical issues. He pointed out that the ED had assured the Supreme Court that no strict action would be taken against her while her writ petition was pending. The ED indicated that their undertaking was only valid until the next postponement. Chaudhary argued that the summons issued under Section 41(A) of the CRPC were inappropriate while the case was pending in the Supreme Court. Initially, notices were given under CRPC 161, and it was unclear why they were later changed to 41(A). He also noted that the ED team was at Kavitha's house during the Supreme Court hearing.
Chaudhary further argued that the CBI sought to interrogate Kavitha while she was in judicial custody, but she was not informed of this petition. According to the CRPC, Kavitha's argument should have been considered before any CBI questioning. He alleged that the CBI made the arrest without an arrest warrant.
The court is expected to hear counterarguments from the ED on Tuesday, with the hearing likely to begin at 12 noon.
